Ordinance 914. C-3 Mobile Home Parks and
Mobile Home Subdivisions |

An Ordinance Amending Ordinance 616 of the City of Mena, Arkansas |
|
Section 1. A zoning designation of C-3 is hereby established for
mobile home parks and mobile home subdivisions: |
- Characteristics: A high density area designed to
encourage the development of properly planned mobile home parks and
subdivisions in a residential environment.
- General Uses: The following and all essentially similar
uses are permitted in this zone:

Mobile Home Subdivisions
- Conditional Uses: The following uses may be permitted after
the Planning Commission has approved the site plan:
1. Churches; Public, private and parochial schools and colleges
(not including industrial trade schools); parks, playground, and open
spaces; utility substations.
2. Accessory Commercial Uses: Grocery Stores, Drug Stores,
Barber and Beauty Shops, Laundries and cleaners, Restaurants (not
drive-in).
In a mobile home park containing at least, one hundred (100) dwelling
units, there may be provided for the convenience of residents of the
development an accessory commercial area. The above accessory
commercial uses and other similar uses may be permitted in the accessory
commercial area after approval of the Planning Commission, provided such
commercial area meet the following conditions.
1. The gross floor area devoted to commercial purposes shall
not exceed ten (10) square feet for each mobile home space in the mobile
home park development.
2. No commercial use within the mobile home park shall be closer
than two hundred (200) feet to any boundary of the mobile home park.
3. Any commercial use shall present no visible evidence of its
commercial character from outside the mobile home park.
- Any C-3 Zone lot established, and permanent structures erected on
any C-3 Zone lot after the effective date of this ordinance shall comply
with the following bulk and area requirements:
1. Minimum lot area: 7,000 square feet.
2. Minimum lot width at building line: 60 feet
3. Maximum building lot coverage (provided minimum setbacks are
observed): 65%
4. Structures shall be set back at least fifteen (15) feet from
property lines adjacent to street lines if no parking is permitted.
Where parking is provided between the structure and property lines
adjacent to street, such structure shall be set back at least forty (40)
feet from the property line. Structures shall be set back at least
ten (10) feet from the rear lot line and from side lot lines.
5. Structures shall be set back at least fifteen (15) feet from
side property line adjacent to a street line if parking is not
permitted. Where parking is provided between the structures and
the side property line adjacent to street, such structure shall be set
back at least thirty (30) feet from the property line. If side
property lines are not adjacent to a street, structures shall be set
back at least ten (10) feet from the rear lot line.
- Minimum size for new zone, four (4) acres.
- Off-Street Parking Required:
1. Residential zone lots - one (1) space per dwelling unit.
2. Non-residential use lots shall provide parking for anticipated
demand.
- It shall be unlawful to park any mobile home to be occupied for
dwelling or sleeping purposes within the city limits of the City of Mena,
as the same now exists or may be hereafter designated, outside a
licensed mobile home park or an approved mobile home subdivision, with
the exception of R-5 zoned tracts.

MOBILE HOME DESIGN STANDARDS
|

ZONE C-3: An Ordinance to establish criteria for operation of a
mobile home park. |
|
DEFINITIONS: |
- "Mobile home" means any vehicle or similar portable structure having
been constructed with wheels, whether or not such wheels have been
removed, and having no foundation other than wheels, jacks, or skirting
and so designed or constructed as to permit occupancy for dwelling or
sleeping purposes.
- "Mobile home park" means any plot of ground upon which one or more
mobile homes occupied for dwelling or sleeping purposes are located,
regardless of whether or not a charge is made for such accommodation.
- "Mobile home space" means a plot of ground within a mobile home park
designed for the accommodation of one (1) mobile home.

SECTION I:
Mobile home parks may be located in any area zoned C-3. A
detailed site plan showing all requirements shall be submitted to the
Code Enforcement Officer for approval. Where any boundary of a
mobile home park directly abuts property which is improved with a
permanent residential building or directly abuts unimproved property
which may, under existing laws and regulations, be used for permanent
residential building construction, a wall, solid fence, or hedge screen
with a minimum height above a finished grade of six (6) feet shall be
provided along such boundary.

SECTION II:
The mobile home park shall conform to the following requirements:
- The mobile home park shall be located on a well-drained site,
properly graded to insure rapid drainage and free from stagnant pools
of water.
- Each mobile home shall provide mobile home spaces and each shall
be clearly defined or delineated. Each space shall have a
minimum dept of sixty (60) feet and width of no less than forty (40)
feet. Each space shall be a minimum of two thousand four hundred
(2,400) square feet.
- Mobile homes shall be soc located on each space that there shall
be at least a fifteen (15) foot clearance in all directions between
mobile homes or buildings within the mobile home park. No mobile
home shall be located closer than ten (10) feet to any property line
of the park, which does not abut upon a public street or highway.
No mobile home shall be located closer than twenty-five (25) feet to
any property line of the park abutting upon a public street or highway
or such other distance as may be established by ordinance or
regulations as a front yard or setback requirement, with respect to
conventional buildings in the zone in which the mobile home park is
located.
- All mobile home spaces shall abut upon a curb and gutter roadway
of not less than twenty-two (22) feet in width, which shall have
unobstructed access to a public street or highway.
- All roadways and walkways within the park shall be hard surfaced
and area lighting shall be required at all roadway intersections and
at three hundred (300) feet intervals along all roadways and walkways.
The minimum size for lamps shall be one hundred seventy-five (175)
watts mercury vapor or equivalent.
- Electrical services shall be constructed in accordance with the
current adopted City Electrical Code.
- Foliage shall be considered in the plan review.
- All mobile home units shall be underpinned.

SECTION III: WATER SUPPLY
An adequate supply of pure water for drinking and domestic purposes
shall be supplied by pipes to all buildings and mobile home spaces
within the park to meet the requirements of the park. Each mobile
home space shall be provided with a cold water tap at least four inches
above the ground. An adequate supply of hot water shall be
provided at all times in the service building of all bathing, washing,
and cleaning facilities.

SECTION IV: SANITATION FACILITIES
Each mobile home park shall provide sanitation facilities in
compliance with the rules and regulations pertaining to mobile home and
travel trailer parks as adopted by the Arkansas Board of Health.

SECTION V: SERVICE BUILDINGS
- Service buildings housing sanitation facilities shall be permanent
structures complying with all applicable ordinances and statutes
regulating buildings, electrical installations, and plumbing and
sanitation systems.
- The service buildings shall be well lighted at all times of the
day and night, shall be well ventilated with screened openings, shall
be constructed of such moisture proof material, which may be painted
woodwork, as shall permit repeated cleaning and washing and shall be
maintained at a temperature of at least 68 degrees Fahrenheit during
the period from October 1 to May 1. The floors of the service
buildings shall be of water impervious material.
- All service buildings and the grounds of the park shall be
maintained in a clean, sightly condition and kept free of any
condition that will menace the health of any occupant or the public or
constitute a nuisance.

SECTION VI: SEWAGE AND REFUSE DISPOSAL
- Waste from showers, bathtubs, flush toilets, urinals, lavatories
and slop inks in service and other buildings within the park shall be
discharged into a public sewer system in compliance with applicable
ordinances or into a private sewer and disposal plant system of such
construction and in such manner as will present no health hazard.
- Each mobile home space shall be provided with a sewer at least
four (4) inches in diameter, which shall be connected to receive the
waste from the shower, bathtub, flush toilet, lavatory and kitchen
sink of the mobile home harbored in such space and having any or all
of such facilities. The sewer in each space shall be connected
to discharge the mobile home waste into a public sewer system in
compliance with applicable ordinances or into a private sewer and
disposal plant system of such manner as will present no health hazard.
Plans for construction of sewage disposal and/or treatment facilities
shall be approved by the State Board of Health and the City of Mena.

SECTION VII: GARBAGE RECEPTACLES
Metal garbage cans with tight fitting covers shall be provided in
quantities adequate to permit disposal of all garbage and rubbish.
Number and location of individual cans or larger central use containers
shall be approved by the Sanitation Department. Garbage cans shall
be located not further than three hundred (300) feet from any mobile
home space. The cans shall be kept in sanitary condition at all
times. Garbage and rubbish shall be collected and disposed of as
frequently as may be necessary to insure that the garbage cans shall not
overflow.

SECTION VIII: FIRE PROTECTION
Every park shall be equipped at all times with fire extinguishing
equipment and hydrants in good working order of such type, size and
number and so located within the park as to satisfy applicable
regulations of the Fire Department. No open fires shall be
permitted at any place which may endanger life or property. No
fires shall be left unattended at any time.

SECTION IX: ANIMALS AND PETS
No owner or person in charge of any dog, cat or other pet animal
shall permit it to run at large or commit any nuisance within the limits
of any mobile home park.

SECTION X: SUPERVISION
The licensee or permittee, or a duly authorized attendant or
caretaker, shall be in charge at all times to keep the mobile home
par, its facilities, and equipment in a clean, orderly, and sanitary
condition. The attendant or caretaker shall be answerable, with
the licensee or permittee, for the violation of any provision of this
ordinance to h the license or permittee is subject.

SECTION XI: PARKING SPACES
Each mobile home space shall have a minimum of two (2) off road way,
ten (10) by twenty (20), all weather parking spaces.
|
SECTION XII:
The validity of this ordinance and adopted code are deemed separable
so that the invalidity of any section or provision of this ordinance
hereby adopted shall not invalidate other sections or provisions thereof
that are in conflict with this ordinance and are hereby repealed.

SECTION XIII:
An emergency is hereby declared to exist by reasons of the immediate
need for mobile home parks in the City of Mena and the delay thereof
will be detrimental to the public health and safety, and provisions of
this ordinance being necessary for the preservation of the public health
and safety, the same shall be in full force in the effect immediately
upon its adoption and passage.
